Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

No person shall infringe on author's property right by means of reproduction, public performance, public transmission, exhibition, distribution, lending, and the making of a derivative work.

The Defendant is a person who has been active in the Internet file-sharing web site (hereinafter referred to as the “ smart file”) operated by the Lartfile Co., Ltd. in Ad'C and Ad'D'.

1. From March 23, 2014 to May 17, 2014, the Defendant violated the Copyright Act of 2011: (a) opened 515 copies of a copyrighted work file, including “the day of the deaf-gu cartoon drama”, on a smart file from March 23, 2014 to May 17, 2014; (b) made it possible for smart file users to download; and (c) converted points according to the frequency of downloads into cash and transferred KRW 279,500 to an account at least four times from April 15, 2014 to May 13, 2014.

Accordingly, the defendant infringed on the author's property right of each of the above works.

2. On April 15, 2014, the Defendant violated the Copyright Act, around 10:54, at the Defendant’s home located in Sinpo-si, Sinpo-si, Sinpo-si, Sinpo-si, access to smart files using computers, and without obtaining permission to use the Victim F, the copyright holder’s copyrighted work, and displayed and distributed the “G files” as his copyrighted work.

Accordingly, the defendant infringed the victim's property right.

3. On May 19, 2014, the Defendant, in violation of the Copyright Act, displayed and distributed the file by downloading the file to a smart file using a computer at the Defendant’s home, such as the preceding paragraph, and without obtaining permission to use the victim H, the copyright holder, at the Defendant’s home, and without obtaining permission to use it from the victim H.

Accordingly, the defendant infringed the victim's property right.
