Punishment of the crime

No person shall have the other party deliver words, sounds, letters, pictures, images, or other things that may cause a sense of sexual humiliation or aversion by telephone, mail, computer, or other means of communication, with intent to arouse or satisfy his/her own or the other person's sexual desire.

1. 피고인은 2015. 2. 8. 16:11경 장소를 알 수 없는 곳에서, 자신 명의의 휴대전화를 사용하여 피해자 D(여, 23세)의 휴대전화로 ‘잔놈도 참 많은갑네, ㅋ 침대에서 뒹굴때가 좋았는데, 가벼워서 들기쉬웠지’이라는 내용의 문자메세지를 전송하여 피해자에게 성적 수치심을 일으키는 내용의 글을 도달하게 하였다.

2. 피고인은 2015. 2. 9. 21:36경 장소를 알 수 없는 곳에서, 자신 명의의 휴대전화를 사용하여 피해자 D의 휴대전화로 ‘ㅋㅋㅋ 하긴 존나 이놈저놈 다빨아대니, 기억안나지, 으휴 아가리부터 잘양치해, 왜 내꺼 빨땐 사랑스럽게 빨더니, 그때 일회용 같고 좋았는데’이라는 내용의 문자메세지를 전송하여 피해자에게 성적 수치심을 일으키는 내용의 글을 도달하게 하였다.
