The defendant shall be innocent.

1. The Defendant in the facts charged is a person who was operating “C” in Jung-gu Incheon Metropolitan City, and F and G are the so-called “Sari,” who was trading in Korea and China. H is a person who was engaged in gold and silver industry in the trade name, which is called “J” in Jongno-gu Seoul, Jongno-gu, Seoul, and “L” in Seoul, Jongno-gu, Seoul, and a person who was married with the Defendant.

On August 8, 2013, the Defendant gathered to import the gold ingots by having the gold ingots from China to Korea and transmitting it to H without filing a report with the head of F, G, H, and M at the office of the above corporation E, Inc., and without filing a report with the head of F, G, H, and M.

Accordingly, the Defendant prepared a gold leader to deliver gold bars to F and G, a book for the transportation of gold in China, through M in China. G and F brought gold bars into Korea by concealing gold bars delivered by the Defendant in the clothes, and H shared the role of delivering gold bars delivered by F and G to the Defendant’s designated person.

Any person who intends to import goods shall file a report with the head of a customs office on the name, standard, quantity and price of the relevant goods, and other matters prescribed by Presidential Decree.

On August 8, 2013, the Defendant directed M to deliver gold bars prepared in advance by the Defendant to F and G in the apartment of “O” in the city for the Chinese dunes to F and G by telephone at the residence of Jung-gu Incheon, Jung-gu, Incheon, and M to F and G according to its direction, M sent gold 8km (cost of goods 316,788,026) from the above apartment.

F and G enter the port of Pyeongtaek-si located in only Dong-ri, Pyeongtaek-si, Pyeongtaek-si on August 17, 2013, without filing a report with the head of the customs office on August 17, 2013, by concealing the 8kg of the above gold leader in the clothes, and the Defendant and H are in the middle of the Eup located in Pyeongtaek-si around that time.
