A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who produces and sells sun-dried salt by operating a salt farm (13,124 square meters) in Jeonnam-gun, Newan-gun.

1. On January 2004, the Defendant: (a) discovered that the victim E (at that time, 36 years of age) was seated with a square in the Yannam-dong, Sinpo-si, Sinpo-si, and that there is no place to go to; (b) said, “I am going to our house to resolve a well-locked place and drinking, and pay money, I am to our house”; and (c) said, I am to a nearby restaurant, “I am to am to the house, I am to am to the house, I am to am a swine, and am to go to the house of the Defendant in the Yannam-gun, Haan-gun.” (c) said, I am the victim on board the ship to F, and am to the house of the Defendant in the G in the Yannam-gun.

Since then, the Defendant stated that “picker is obvious to grow up with another house, and our house is written down and frighter is known to frighter,” thereby preventing the victim from escaping from another place, and then had the victim take labor force from November 15, 2013 by allowing the victim to do work in the salt farm operated by the Defendant, and entices the victim for profit.

2. A quasi-Fraud Defendant, using the fact that the victim was unable to exercise the right to claim a normal wage due to lack of intellectual ability, committed as if the victim did not have the intent or ability to pay a normal wage to the victim and had the victim do work in the salt farm operated by himself/herself and took the work into consideration the labor force.

Accordingly, on January 1, 2004, the Defendant made a false statement to the victim in the Defendant’s house, stating, “I will give 3 million won won per year if he or she was infected” to the victim.

Therefore, the Defendant did not pay 786,480 won for the victim’s benefits to be paid to the victim on or around May 2007 after having the victim continue to work as a salt farm that produces salt from his salt farm (the minimum wage amount published by the Ministry of Employment and Labor).
