A defendant shall be punished by imprisonment for not less than two years and three months.

Punishment of the crime

The Defendant, “2013 Highest 215,” who was employed at a convenience store, had been employed in disguised E- stores operated by the victim D with the victim D on January 17, 2013.

At around 19:45 on the same day, the Defendant sent F, who was employed as an employee, with the defect of leaving the post, and then stolen 32 copies of cultural products worth KRW 120,000, and market value of KRW 305,000, which are owned by the victim in small-sized safes of convenience stores.

1. Around November 26, 2012, the Defendant made a false statement to the effect that “Around November 26, 2012, the Defendant: (a) paid money to the victim from the PC bank operated by the victim H in G in Jeonju-si; (b) was a check, which does not have been immediately found; and (c) was to pay back the money as the check is withdrawn.”

However, the defendant did not intend to repay the money even if he borrowed the money from the victim, such as escape with the borrowed money.

Accordingly, from November 26, 2012 to the next day, the victim delivered a total of KRW 2,10,000 to the defendant three times in total.

2. On November 27, 2012, the Defendant: (a) acted in the said IPC as if he would pay the victim fee; (b) used approximately KRW 20,000 in the PC; and (c) used the PC equivalent to KRW 20,000.

However, in fact, the defendant did not intend to pay user fees even if he/she uses the PC, such as leaving the above IPC and leaving it back without paying the borrowed money.

Accordingly, the victim used the PC at the above IPC, and thereby the defendant acquired approximately KRW 20,00 property benefits.

The Defendant, on September 12, 2008, sentenced on September 12, 2008, to one year and two months of imprisonment in the Busan District Court for fraud, etc., and on May 12, 2009, executed the sentence in the port prison on May 12, 2009.
