Reasons
Punishment of the crime
The Defendant was sentenced to six months of imprisonment for fraud, etc. at the Busan District Court on April 24, 2015, and the above judgment became final and conclusive on June 24, 2015. On April 1, 2016, the Defendant was sentenced to six months of imprisonment for a violation of the Act on Financial Business Specializing in Credit, and the above judgment became final and conclusive on August 10, 2016.
[Criminal facts]
1. The Defendant: (a) was registered as the business owner on June 30, 201 in the name of “(State) E” [hereinafter “F”) and sold health functional foods, etc.; (b) entered into a contract with the company to purchase and sell health functional foods from the company (State) with the company; (c) was not delegated with the authority to purchase and sell the functional foods; and (d) was stored in inventory the orders of KRW 46 million due to the low sale of health functional foods ordered by the company; (b) was under any circumstances in which the company is urged to pay inventory and raw materials in stock; and (c) the company did not have any intention to sell health functional foods, including lending funds equivalent to KRW 400,000 from May 30, 2014 to July 20, 2014; and (d) there was no intention to receive deposits or other financial resources from the victim, even if there was no intention to receive deposits or other financial resources from the company.
Nevertheless, the defendant, on August 2014, has been operating E in the office of the (State) F in Busan-gu, Busan-do, where the victim received the total sales right for health functional foods from the (State)G, and the managing director is seeking.
The managing managing director shall deposit the deposited amount of KRW 40 million in the place where the company manages the company's business and deposits the deposited amount of KRW 320,000,000. The management director shall guarantee monthly salary of KRW 320,000,000, and shall pay KRW 400,000 per month interest to the deposited amount and immediately return the entire amount if the company wishes to retire.
