All appeals filed by the defendant and prosecutor are dismissed.
Reasons
1. According to the records of the instant case’s judgment on the Defendant’s appeal, the Defendant submitted a petition of appeal on December 11, 2012, which was sentenced to the judgment of the lower court on December 11, 2012, to the 7th day of the appeal period, the Do Do Do Do Do Do Do Do. The Defendant’s appeal is unlawful as the period for filing an appeal expires, and thus, it should be dismissed by decision pursuant to Articles 361-4(1) and 361-3(1) of the Criminal Procedure Act, but the prosecutor also appealed.
2. Judgment on the prosecutor's appeal
A. The summary of the grounds for appeal (fact-finding) O, P, and W reversed each of the facts charged in this case against the defendant at the court of the court below, which correspond to the acts of forging private documents and uttering of falsified investigation documents as of February 19, 2008 and April 15, 2008, respectively, and the court below acquitted the defendant of this part of the facts charged on the ground that there is no credibility of the aboveO's statement in an investigative agency, including the aboveO, on the ground that there is no credibility of the statement. The court below erred by misapprehending the facts and affecting the conclusion of the judgment.
B. The facts charged and the judgment of the court below in this part of the facts charged are that Defendant B is North Korean defectors and is acting as an agent for the marriage report, and that Defendant B is acting as an agent for the marriage report on condition of receiving KRW 700,000 from A.) Defendant B, in preparing the marriage report by the victimO and P, did not have obtained consent from the victimO and the witness column for the marriage report report. However, around February 19, 2008, Defendant B forged the marriage report, which is a private document, by stating that “O, Qu-do, Seoul Special Metropolitan City, R apartment 105-709”, “P, S pursuant to the marriage report by the witness column for Defendant A, in the public service center of the Dong-gu Incheon Metropolitan City, Seoul Special Metropolitan City Office, stating that “I and Qu-gu T apartment 306-902” was signed.
