B is a person in charge of safety and health management at the construction site of the above D-style Newly constructed construction site under the jurisdiction of A, a corporation established for the purpose of building construction business, etc. by the C, which the company received a subcontract from D.

1. Defendant B

(a) When workers are engaged in any work in danger of fall or falling down, the business owner shall install a work launch plate, etc., and when it is difficult to install a work control net, he/she shall take measures to prevent workers from falling down danger, such as installing a safety control net or allowing workers to wear a safety belt;

Nevertheless, on February 6, 2014 and around February 22, 2014, the Defendant did not take measures to prevent workers from falling dangers, such as allowing workers to work on a steel-frame structure with a height of at least 3 meters at the above construction site, to install a safety net, or to wear a safety belt.

(b) When the business owner does work at a place where workers fall or come to fall or come to fall, or machinery, equipment, etc., he/she shall install a working board by assembling a rain gauge, etc.;

Nevertheless, on February 25, 2014, the Defendant did not install a work plate by allowing workers to engage in fry work on a steel-frame structure with a height of at least 2 meters at the above construction site.

2. Defendant A, who is an employee of the Defendant, did not perform his duty to take measures to prevent industrial accidents as described in the above paragraph (1) at the same time and at the same place as the above paragraph (1).
