The defendant shall be innocent.

1. On May 20, 2017, the Defendant: (a) informed of E at a D club in the vicinity of Gwangju-gu, Gwangju-gu; and (b) had sexual intercourse with E on May 22, 2017 at the Defendant’s home located in Gwangju-gu, 203 Dong-gu, 206, around May 22, 2017.

On May 24, 2017, the Defendant: (a) on May 22, 2017, at Joseon-dong University Hospital Mabakia Center located in Gwangju-dong-gu, Gwangju, without having been subject to sexual assault to E; (b) on May 22, 2017, E forcedly laid the Defendant from her bed, laid off the Defendant into her bed and took out sexual assault.

A false statement of complaint shall be prepared and submitted, and at the same day, the defendant shall not be the defendant to a police officer belonging to the above police station.

In doing so, E’s resistance to E was sealed by force of the Defendant, but E was raped by inserting her sexual organ into the Defendant’s sound book.

A false statement and E made a false statement for the purpose of having E receive criminal punishment.

2. Determination

A. According to the evidence duly admitted and examined by this court, the following facts are recognized.

(1) The Defendant is a university student attending a shipbuilding University.

B. On May 20, 2017, the Defendant went to a D club along with his her flup and first flup with his her flup, and the following day, even if she tried to go to a flup with her flup, but no flup had been made soup. Applicant The Defendant and E have delivered legs by smartphones around 13:58 on May 22, 2017, and around 14:12, the Defendant and E have been delivered to the Defendant’s home. Among them, the Defendant and E have sexual intercourse and enter the bath together.
