위와 같은 모의에 따라, 피고인과 D, B은 2017. 3. 16. 22:00경 전주 소재 피해자가 운영하던 식당 및 인근 노래방에서 피해자와 함께 술을 마시고, 다음날 04:30경 D는 술에 취한 시늉을 하면서 피해자와 함께 모텔로 이동한 후 피해자와 서로 합의하에 성관계를 가졌음에도 불구하고, D는 같은 날 13:20경 자신이 마치 성폭행을 당한 것처럼 광주 F에 방문하여 성폭행 피해 신고를 하고 DNA 검사를 받았다.
