A defendant shall be punished by imprisonment for six months.

Provided, That the execution of the above punishment shall be suspended for two years from the date this judgment became final.

Punishment of the crime

On July 4, 2013, the Defendant was sentenced to a suspended sentence of one year and two months in Seoul Western District Court for fraud, etc., and the said judgment became final and conclusive on November 14, 2013.

The Defendant, while working as a start-up consultant for C Co., Ltd. (hereinafter “C”) with the purpose of business start-up consulting, committed a start-up local hosting against C’s customers in addition to start-up consulting. On February 2010, the Defendant promised to attract investment to F and to receive part of the investment amount from F after receiving a request for attracting investment from F, a de facto operator of D and E for the purpose of clothing wholesale and distribution business.

1. Around June 20, 2010, the Defendant: (a) at the coffee shop located in the first floor of H building in Songpa-gu Seoul Metropolitan Government, the Defendant: (b) “When investing KRW 60,000,000 in D operated by F, he/she shall repay the principal until June 24, 2011; and (c) paid KRW 2,50,000 each month to the victim for two years; (d) D has a total qualification for domestic monopoly supply of J brand; (b) K is opening and operating the online shopping mall; (c) there is a direct sales store located in the name Dong-dong, and (d) it is expected that two stores will open the off-line new store even at the debate, so a large amount of sales will be expected to increase in the future; (d) D is the last investment from four investors; and (e) the victim must promptly make a decision on whether to make an investment.”

However, in fact, D and E’s debt amounting to KRW 130,00,000, and the amount of tax was in arrears with KRW 66,000,000, and its employees did not pay wages smoothly. From January 2010 to September 2010, the average monthly sales amounting to KRW 5,00,000, etc. was not extremely good.
