The defendant's appeal is dismissed.

1. The gist of the grounds for appeal is that the Defendant did not instruct the knife and threatened the victim.

Nevertheless, the judgment of the court below which found the Defendant guilty of the facts charged of this case is erroneous and adversely affected by the judgment.

2. According to the evidence of the court below following the judgment, the court below's judgment convicting the defendant of the facts charged of this case is just, and there is an error of law by misunderstanding facts and affecting the conclusion of the judgment.

Defendant’s assertion is without merit.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition, since the defendant's appeal is without merit.
