1. The Defendant (Counterclaim Plaintiff) paid KRW 100,000,000 to the Plaintiff (Counterclaim Defendant) and its payment from December 11, 2012 to January 21, 2015.

1. Facts of recognition;

A. On January 26, 2012, the Plaintiff entered into a contract for the supply of manufacturing facilities (hereinafter referred to as “instant contract”) with the Defendant, a corporation that runs a business of manufacturing Aldyp, Aldyp plastic machinery and equipment, and an interim waste disposal business, etc., and the Plaintiff’s factory scheduled to be newly built on the ground of the 487-1, Kim Jong-dong, Kim Jong-dong (hereinafter “instant factory”) to install products for crushing and crushing of construction mixtures wastes (hereinafter “this case’s plant”). The details are as follows.

§ 1 (Name of Contract). Manufacture and installation of facilities for crushinging, crushinging and crushing wastes of construction mixture

1. Manufacturing of manufacturing facilities, and installation and trial operation;

2. Date of contract;

3. After the launch of machinery, the Defendant shall complete the design approval in consultation with the Plaintiff and the Defendant on the Plaintiff’s request for modification and addition of the terms and conditions under the contract, and the Defendant shall proceed with the approved design documents after checking the Plaintiff.

4. The disposal capacity shall be 13 to 15T/H. The disposal disorder disorder shall be sufficiently familiar with the Plaintiff’s factory (it shall not include combustible products, among construction wastes), and foreign substances, such as heavy objects, noncombustible materials, and hardware, etc., not more than 50m.

1. Construction amount: One hundred and eighty billion won (one thousand eight hundred,00,000,000 won) for each value-added tax (which may cause a change in the construction amount according to the detailed design); and

2. Down payment: A daily KRW (100,000,000) deposit shall be paid after the approval of the plaintiff, after submitting the design documents.

3. Part-time payments: The sale of daily gold (800,000,000 won);

4. Balance: The remainder of Won Won (900,000,000) will be paid after passing a performance test (140 consecutive hours and 15T/H).

Article 7 (Compensation for Delay) The defendant shall be under Article 2.
