Reasons
Punishment of the crime
1. Notwithstanding the absence of an intention to establish a company with E and to operate an actual company, the Defendants’ joint crime committed the following acts: (a) opened an account in the name of a juristic person by inviting nominal lessees; (b) selling an access medium such as cash card connected with the company via the Internet, etc.; and (c) selling the proceeds therefrom through the Internet, etc.; and (d) performing the overall control over the establishment and sales of the passbook; (b) Defendant A performs the role of soliciting lending persons in the name of the head of a Si/Gun/Gu; and (c) Defendant B, while driving the vehicle, intended to share the role of introducing the procedures, etc. at the tax office and the bank to the nominal borrowers.
A.
