1. The Defendant’s KRW 77,887,956 for the Plaintiff and its related KRW 5% per annum from May 30, 2014 to February 17, 2016.

1. Basic facts

A. The Plaintiff is a company that manufactures films, and the Defendant is a company that acquires films and supplies them to other companies after conducting hosting work.

B. On March 28, 2013, the Plaintiff entered into a contract with the Defendant for the supply of films, such as the Defendant’s protective films (LDPEs, 0.043 x 1040 x 300 x 300), protective films (LDPE color, 0.04 x 1040 x 300).

C. The Plaintiff supplied the Defendant with films equivalent to KRW 211,851,166 in total amount of goods from March 29, 2013 to August 17, 2013 in accordance with the said goods supply contract.

The Defendant paid KRW 133,963,210 to the Plaintiff from May 8, 2013 to October 1, 2013.

마. 주식회사 향한은 2013. 7. 3.경 피고에게 보호랩에서 불량이 발생하였고, 이로 인하여 5개 라인 공정이 멈췄고, 출고를 하지 못하여 납기에 큰 차질이 발생하였으며, 2013. 6. 12.부터 2013. 6. 30.까지 랩 제거 작업을 하였다는 내용을 내용증명으로 보냈다.

F. Around July 15, 2013, the Plaintiff and the Defendant returned film on the grounds that the film supplied by the Defendant was defective, and the Plaintiff and the Defendant returned the film to the Plaintiff, and the Plaintiff agreed not to claim KRW 9,607,500 for the film price against the Defendant.

G. On September 30, 2013, same-sexex Co., Ltd.: (a) around September 30, 2013, the Defendant sent documents stating that on August 30, 2013, the same-sexex Co., Ltd. (hereinafter “FEAL”) sent to the Defendant on the receipt of customer’s payment from the same-sexex, which was supplied by the same-sexex, to the Defendant on August 30, 2013; and (b) the protection films were sent at the time of deculing by the higher level of the protection films. (c) On August 28, 2013, 2013, the document sent to the Defendant on July 18, 2018 (50 x 100 x 100 x 100 x 100) supplied on July 15, 2013.

H. It is not easy to remove the films for the protection of materials supplied to the Defendant around October 23, 2013 by same-sex architecture Co., Ltd.
