1. Basic facts

가. 원고는 2013. 6. 3.경 피고와 사이에 원고 소유의 부산 수영구 B 부산도시철도 2호선 C역 지하 1층 중 별지 도면 표시 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 1의 각 점을 순차로 연결한 선내 상가 32,910.4㎡ 중 a, b, c, d, a의 각 점을 순차로 연결한 선내 ㈎ 부분 46.60㎡(이하 ‘이 사건 35호 점포’라 한다), e, f, g, h, e의 각 점을 순차로 연결한 선내 ㈏ 부분 53.20㎡(이하 ‘이 사건 42호 점포’라 한다), 12, 13, i, j, 12의 각 점을 순차로 연결한 선내 ㈐ 부분 점포 87.32㎡(이하 ‘이 사건 44호 점포’라 한다) 및 10, 11, k, l, 10의 각 점을 순차로 연결한 선내 ㈑ 부분 점포 44.16㎡(이하 ‘이 사건 46호 점포’라 하고, 위 35호, 42호, 44호, 43호 점포를 통틀어 ‘이 사건 각 점포’라 한다)에 관하여 아래와 같은 내용의 임대차계약(이하 ‘이 사건 임대차계약’이라 한다)을 체결하였다.

- Contract price (total rent for five years): 35-24,60,000 won, 42-29,400,000 won, 44-90,000,000 won, 46-19,800,000 won: Amount equivalent to 10% of each of the above contract amount by store - Payment deposit such as rent, etc. - Amount equivalent to 20% of the above contract amount by store - Contract period: From June 3, 2013 to June 2, 2018 - Payment method of rent (Article 3): B (the defendant's name; hereinafter the same shall apply) shall be equally paid in installments on a one-month basis, regardless of the existence of any business activity.

- Contract bond (Article 4): ① A contract bond must be paid in cash or a surety insurance contract amounting to at least 10/100 of the contract amount as a penalty for penalty to guarantee the execution of the contract, etc. before the conclusion of the contract

(3) A contract bond (referring to a plaintiff; hereinafter the same shall apply) shall revert to the full amount of the contract bond, if any of the following causes occurs:
