1. The Defendant’s KRW 31,895,733 as well as the Plaintiff’s annual rate from March 20, 2015 to May 25, 2017.

1. Facts of recognition;

A. The Plaintiff concluded a fire insurance contract with the victim B with the following content.

B. In around 2013, the Defendant manufactured 20kW 2 of the heat media boiler for the 20kW oil pressure press press, and supplied it to the factory where the subject matter of insurance is located.

The principle of operation of the heat media boiler is to open all valves (the valves attached to the pipes created by the heat media oil to the press machine) in the heat media boiler after setting up the temperature of the heat media oil with all of the boilers, and to operate the pumps when putting the operation of the engine, and to operate the machinery necessary for product manufacturing by circulating the heat media oil inside the boiler with the pipes attached to the boiler.

The heat media oil, which is inside boilers, flows out through a pipe installed outside the boiler and flows out of the boiler, operates the press machine by temperature. The heat media oil from the vehicle, which re-enters the boiler into the boiler and gets off by the pumps, and then gets out the pipe and operate the press machine.

In the above operating method, there are one and one at the upper end of the heating media boiler, and the upper end valves are the pipe valves transmitting heat oil to the press machine, and the lower end valve is the pipe in the pipe which circulations the press machine and re-enters into the boiler.

C. At around 10:05 on December 28, 2014, the aggrieved party, when operating the said heat boiler supplied by the Defendant (hereinafter “instant boiler”) in order to operate a press system for manufacturing the stoves under the stoves of the stoves, distributed out the pressure tank oil in the boiler installed on the upper part of the boiler due to heat of the boiler to the stove in the front stove of the boiler.
