Punishment of the crime
[Criminal Justice] On October 23, 2014, the Defendant was sentenced to imprisonment with prison labor for a crime of fraud at the Daegu District Court on October 23, 2014, and the judgment became final and conclusive on October 24, 2014.
【Criminal Facts】
The Defendant had been operating a multiple number system as a fraternity since 2007. Around July 201, it was difficult for the Defendant to operate the fraternity due to the members of the fraternity who did not pay the fraternity properly. In order to collect the operating funds of the fraternity that became insufficient, the Defendant organized a new system and paid the fraternity principal received from the fraternity members as the fraternity deposits in another fraternity, and operated the so-called re-returning system. Therefore, even if the system is newly organized, the Defendant did not have any intention or ability to pay the fraternity to the fraternity at the time.
1. Around October 27, 2011, the Defendant made a false statement to the victim E, “If the Defendant subscribed to the 26-Gu unit, 10 million won unit, which begins from the Lao, and paid in an additional amount of KRW 400,000 per month, the Defendant would pay KRW 10,90,000 to the victim E, from July 27, 2012.”
As above, the Defendant, by deceiving the victim as above, received KRW 400,000 from October 27, 201 to that of the victim, and around July 27, 2012, changed from the victim’s sequence, and continued to pay monthly payments from the victim until October 27, 2012, and received KRW 5,20,000,000 from the victim for the total sum of KRW 400,00 per month until October 27, 2012.
2. Around October 27, 2011, the Defendant made a false statement to the victim G, stating, “When he/she opens a 26-gu unit, 20 million won unit, which begins from the date of the increase, and pays 800,000 won each month, to the victim G during the F farm located in C, he/she will pay an amount of KRW 20,000,000 in the order of 22th of July 27, 2013.”
