A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Crime C related to the victim;

A. On February 2, 2012, at a place where the location is unknown, the Defendant forged private document: “location of real estate: Eunpyeong-gu Seoul Metropolitan Government (2nd floor), land category (2nd floor), commercial house, building (building, purpose), residential house, deposit amount of KRW 90,00,000, lease period, and January 5, 201 through January 5, 2013, at a location where the location is unknown, the Defendant arbitrarily stated the personal information of F real estate G in the E and broker column, and affixed seals created by the Defendant on the name of the said E and G, respectively.

Accordingly, for the purpose of exercising rights and obligations, the Defendant forged one copy of the real estate lease contract under the name of lessor E and broker G, which is a private document.

B. On March 8, 2012, the Defendant: (a) borrowed 6 million won as security the lease deposit from Jongno-gu Seoul Jongno-gu Seoul Metropolitan Government Office in the Songwon Office; (b) granted the forged lease contract to C as if it was a document that was duly formed; and (c) exercised it.

C. On March 8, 2012, the defrauded presented a forged real estate lease contract to C (the age of 60) at the Songwon Office in Jongno-gu Seoul, Jongno-gu, Seoul, stating that “if living expenses are required and money is lent as security for real estate lease contract, it would be repaid after three months.”

However, even if the defendant borrowed money from the victim, he did not have the intention or ability to repay it on the agreed date, and the lease contract provided as a security document was forged by the defendant.

As above, the Defendant, by deceiving the victim as above, received 6 million won in cash from the victim’s seat.

2. The facts constituting the crime regarding the loan with the victim (state) error;

A. The Defendant forged a private document at a place where it is difficult to identify the place on January 201.
