1. Defendant C’s KRW 6,00,000 as well as annual 5% from March 17, 2014 to August 5, 2014 to the Plaintiff.

1. Determination as to the claim against Defendant C

(a) Indication of claims: It is as shown in the attached Form;

(b) Judgment on deemed confession (Article 208 (3) 2 of the Civil Procedure Act);

2. Determination as to the claim against the defendant B, D, and E

A. On March 17, 2014, around 10:30, 2014, the Plaintiff called the Plaintiff’s phone, “The Plaintiff’s financial information was leaked.” The Plaintiff sent a false message to the Internet website address of the public prosecutor’s office, and the Plaintiff entered all financial information, such as the number of a new bank account (F), the identification number of a personal identification card, and the identification number of a new bank security card in the name of the Plaintiff. 2) On the same day, the Plaintiff was transferred KRW 5,700,000 in total to Defendant B’s account as indicated in the following table.

In addition, on the same day, from the new bank account under the name of the plaintiff to the account under the name of defendant D and E, the amount as described below was transferred.

(1) The following facts are revealed: (a) The Defendant Nonghyup Bank Co., Ltd.’s total account number transfer amounted to KRW 5,700,000 in KRW 5,781,500 in Defendant Samsung F Co., Ltd.’s KRW 15,762,00 in KRW 15,762,00 in the name of the account holder; and (b) the purport of the entire arguments and arguments by each entry in subparagraphs A through 6 (including the serial number); and (c) the purport of each entry in the evidence of subparagraphs 1 through 6 (Ga number);

B. The Plaintiff’s assertion 1 of the parties could have anticipated that their accounts and cash cards, etc. may be used for the instant offenses, but aided and abetting the instant offenses by using them to the name defecters. As such, the Defendants are liable to compensate the Plaintiff for the damages incurred by the instant offenses.
