A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[Criminal Power] On October 1, 2019, the Defendant was sentenced to a suspended sentence of two years on October 9, 2019 by imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. at the Seoul Central District Court, and the said judgment became final and conclusive on October 9, 2019.

【Criminal Facts】

Despite the fact that the Defendant is not a person handling narcotics, the Defendant dealt with the psychotropic drugs-related Mesofts (i.e., one philopon; hereinafter referred to as “philopon”), as follows:

1. Purchasing philophones;

A. On April 13, 2019, the Defendant decided to purchase philopon from a nameless person who became aware of via the Internet, remitted 700,000 won of philopon to a corporate bank account in the name of B known by the seller at around April 14:27, 2019, and then purchased philopon from a philopon stairs located in the name of the seller at a store below Seocho-gu Seoul Metropolitan Government Yang Jae-dong.

B. On June 17, 2019, the Defendant decided to purchase philophones from the above seller, remitted 400,000 won of philophones to the D bank account in the name of C known by the said seller at around 15:18, and around that time, purchased philophones by using approximately 0.5g of philophones concealed by the said seller from the philophones located in the name of C, Songpa-dong, Songpa-gu, Seoul.

2. Medication of phiphones.

A. The Defendant: (a) on April 13, 2019, at the residence of the Defendant of Gangnam-gu Seoul building F, the said 1. A.

The philophone administered a philophone in such a way as to put the philophones purchased into a glass pipe and inhale the smokes caused by heating the philograms.

B. On June 17, 2019, the Defendant, at the residence of the above Defendant, 1.B.

As stated in the paragraph, the philophones purchased were administered in such a way as above.

C. On June 19, 2019, the Defendant, at the residence of the above Defendant, 1.B.

As in the paragraph, the philophones purchased were administered in such a way as the above.

On June 22, 2019, the defendant is the above defendant.
