1. 특수상해 피고인은 2016. 6. 7. 14:40경 서울 은평구 C에 있는 D 편의점 앞에서 피해자 E(33세)이 목공 작업으로 바쁘게 일하고 있는 피고인을 위 편의점으로 불러내었다는 이유로 화가 나 피해자에게 “이런 미친 새끼가 죽으려고”라고 큰 소리를 지르면서 피고인이 메고 있던 연장가방 안에서 위험한 물건인 장도리(길이 약 40cm 가량)를 꺼내어 피해자 바로 앞에 있는 탁자를 1회 내려친 후 그 탁자가 쓰러지면서 피해자도 같이 지면으로 넘어지자 위 장도리를 손에 쥔 채 발로 피해자의 얼굴 부위를 1회 걷어 차 치료일수 미상의 안면 타박상을 가하였다.
