Reasons
1. Facts of recognition;
A. On November 13, 2012, the Plaintiff and Defendant A on November 13, 2012: CNC 3-Axis Luss Machine L4030/196 (attached Form; hereinafter the same shall apply), ② Lease price: 270,00,000 in Korea, ③ Lease period: 48 months: 44,000, 54,000,000, and 54:5% in interest rate: 6% in each month; 75% in interest rate: from 1 to 3 times; 5,750, 300, and 48 times in interest to 48 times; and 84,750, 300 in interest to the leased article; and 8, the Plaintiff shall have the right to use the leased article in this case to return the leased article to the Plaintiff (the lease article in this case shall be returned to the Plaintiff); and the lease property in this case shall have the right to use the leased article in this case.
The Plaintiff purchased the leased article of this case and delivered it to the Defendant A.
B. On February 2, 2015, the Plaintiff notified Defendant A of the termination of the instant lease agreement and by content-certified mail on the ground that the Defendant had failed to pay the monthly rent at least twice a month under the instant lease agreement (the delayed principal amount of KRW 20,138,323). The mail certifying the contents of the agreement reached the Defendant A.
C. Defendant B purchased and possessed the leased article of this case from Defendant A on September 15, 2014.
Evidence: The defendants possessing the leased article of this case, unless there are special circumstances, are obliged to deliver the leased article of this case to the plaintiff who is the owner of the property of this case according to the above facts acknowledged as evidence Nos. 1 through 8, No. 9-1, 2, and the purport of the whole pleadings.
2. On September 15, 2014, Defendant A purchased the instant leased article from Defendant A in KRW 156,250,000, and paid KRW 65,000 as down payment, Defendant A paid the lease fee of KRW 11 months each month to the Plaintiff as the down payment, and the remainder amount of KRW 91,250,000 to the same Defendant.
