The punishment of the accused shall be determined by a year of imprisonment.

Punishment of the crime

1. Around September 10, 2015, the defrauded: (a) the Defendant borrowed money from the victim C to whom he/she became aware of through online hosting at a mutually unclaimed restaurant in the Dong-gu, Gwangju-gu, Gwangju-gu, by stating that “A person has no living cost; (b) his/her father has lent money to another person; (c) he/she is in need of money; and (d) he/she is required to receive money; and (d) he/she is expected to receive money from the victim to pay the money properly.”

However, in fact, the Defendant did not have certain income or property, and his father did not lend money to another person, and thus, the Defendant was unable to pay such money even if he borrowed money from the victim because he did not have any money to another person.

The Defendant received KRW 85,758,500,00 in total over 66 times from September 10, 2015 to June 24, 2016, including the receipt of KRW 500,00 in cash from the victim around September 10, 2015.

Accordingly, the defendant was given property by deceiving the victim.

2. On September 2015, the Defendant, like paragraph 1, had the victim lent money from the victim to the police, and had the victim threatened the victim to report on the fact that he/she had his/her chest to the police in order to raise money from the victim.

On July 2, 2016, at around 11:31, the Defendant sent a text message from the Defendant’s house located in Gwangju Northern-gu, that “I will receive the complaint if I wish to do so by 20 or 30 days. I also want to do so.” On July 5, 2016, the Defendant sent the victim a text message stating “I would like to receive the complaint” to “I would like to bring the victim into the atmosphere while I would like to file a complaint by indecent act.”

The defendant is the name of the defendant against the victim of frightage.
