1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. The Plaintiff is a person who was appointed as a policeman on July 1, 2002 and served as a police officer in Busan and Ulsan District on September 1, 2008, such as promotion to a slope on September 1, 2008, and on September 1, 2014.
B. On October 11, 2016, the Ordinary Disciplinary Committee for Police Officers in Busan Southern Police Station violated Article 56 (Duty of Good Faith), Articles 57 (Duty of Good Faith), 63 (Duty of Maintain Dignity) of the State Public Officials Act, Articles 3 (Duty of Good Faith and Integrity) (6), 4 (e.g., Duty of Integrity) and 7 (General Action) of the Regulations on Police Officers’ Service, and Article 78 (1) 1, 2, and 3 of the State Public Officials Act on the ground that the Plaintiff’s act constitutes grounds for disciplinary action under Article 78 (1) 1, 2, and 3 of the State Public Officials Act. Accordingly, on October 13, 2016, the Defendant resolved on the “defluence” against the Plaintiff.
In spite of the fact that police officers were faithfully engaged in complying with the laws and regulations and were not able to impair their dignity regardless of whether they were inside or outside their duties, the Plaintiff entered a restaurant of “C” located in the military motive and metab, at around 19:0 on September 26, 2016, the Seosan subway Station No. 19:00, the Seosan subway Station No. 19:00 on September 26, 2016, and placed 2-hour more than 2 hours on the order of 3 soldiers in the Siwonri-gu, the Plaintiff is on duty in the direction of a mixed market;
