A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2017 Highest 44"

1. On August 8, 2015, the Defendant violated the Resident Registration Act by providing a resident registration number (F) of E, which came to know at the time when he/she works for a shopping mall company in Kuri-si, Seoul, to enter the same in the original records of the hospital. On the same day, the Defendant submitted a prescription stating the above personal information to “G pharmacy” to “G pharmacy” and received medicine, and used another person’s resident registration number more than 42 times from around that time to May 14, 2016 as described in the attached list (1) of the crimes committed in attached Form 42.

2. Around August 8, 2015, the Defendant, upon receiving medical treatment from the above “D Council member”, committed as if he/she was E, and was paid insurance benefits of KRW 12,960 from the National Health Insurance Corporation to May 14, 2016 by the following means: (a) the Defendant was provided with hospital, pharmacy, etc. or medicine at a hospital, pharmacy, etc. over 42 occasions as described in the attached Table (1) by deceiving the victim by such means as above, and acquired the total sum of KRW 930,670 from the victim as insurance benefits.

"2017 Highest 3242"

1. On August 13, 2014, the Defendant violated the Resident Registration Act: (a) the first member of the Council located in H in Nam-si, Namyang-si; (b) the Defendant had been aware of the past work for the said member;

J's resident registration number (K) was notified and provided medical treatment and used unlawfully.

The defendant, including this, received the medical treatment of the above resident registration number from a hospital in the total of 7 times as shown in the list of crimes in attached Form 2, and used the other person's resident registration number unlawfully over 5 times in total.

2. On August 13, 2014, the Defendant violated the Act on Fraud and the National Health Insurance (hereinafter “National Health Insurance”) committed as if he/she was his/her J, by informing him/her of his/her resident registration number when he/she was given medical treatment to prescribe the exemption.
