A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
The Defendant acquired one driver’s license lost at a place near the new village of Seodaemun-gu Seoul Metropolitan Government, where it is unknown in 2008, and used the above driver’s license as B, and had the driver’s license used it as if it were B, and had the driver’s license used it for medical treatment at a hospital, pharmacy, etc., or had the drug prepared.
1. On April 6, 2012, the Defendant submitted a certificate of receipt to the Gangnam-gu public health clinic located in Gangnam-gu, Seoul, Seoul, by stating his/her name and resident registration number as if the Defendant was B. After receiving medical treatment from the medical doctor in the name of the region, the Defendant exempted the victim of the National Health Center (hereinafter “victim”) who is aware of such fact from paying KRW 3,190 to the Corporation, claiming for medical expenses to be borne by the Corporation (hereinafter “the charges charged in fraud”) and allowing the damaged public health center to pay medical expenses equivalent to the Corporation’s medical expenses. From around that time to June 23, 2017, the Defendant was treated as B more than 72 times in total as if he/she were a medical institution, or obtained medicine to the damaged public health clinic, and paid the Corporation a total of KRW 5,022,230,00 to the damaged public health center for medical expenses equivalent thereto.
Accordingly, the Defendant acquired property benefits by deceiving the damaged Corporation.
2. On August 18, 2014, the Defendant violated the Resident Registration Act: (a) at the D pharmacy located in Seodaemun-gu Seoul, Seodaemun-gu, Seoul, the Defendant, as if the Defendant was B, used the B’s resident registration number on 50 occasions in total, as described in [Attachment 23] Nos. 23 through 72, from around that time to June 23, 2017, the Defendant unlawfully used the B’s resident registration number on 50 occasions, as shown in [Attachment 23] Nos. 23 to 72.
In this respect, the defendant used another person's resident registration number unlawfully.
3. The Defendant who violated the National Health Insurance Act.
