Reasons
Punishment of the crime
1. [2015 Godan118] On February 19, 2013, the Defendant filed an application for a loan with the intent to pay 724,434 won each month during the 36-month period for a loan of KRW 17.4 million in the name of the fund for purchasing DNA cars with the victim Korean employees introduced by the said employees through the said used cars trading company at the used cars trading company located in Yangcheon-gu Seoul Metropolitan Government.
However, at the time, the Defendant had a debt of 40 million won or more due to gambling, and there was no intention or ability to repay the debt even if the Defendant had received a loan from the victim due to the lack of any income, and it was thought that the Defendant purchased the said car and sold it to the large vehicle and provided money.
Nevertheless, the Defendant, through the employees of the above used vehicle sales company, by deceiving the victim while applying for a loan to the victim, obtained a loan of KRW 17.4 million from the victim on the same day as the purchase price for the above used vehicle on the same day.
2. [2015Kadan1360] In collusion with the friendship E, the Defendant made a false statement to the effect that, around November 22, 2013, the Defendant would lend the game character to the victim F by using the mobile fishing system “H” to the Defendant’s cell phone located in the gold-gu, Busan Metropolitan Government with the cell phone located in the name of the Defendant, and the victim F of the Victim F of the Republic of Korea using the mobile fishing system “H” at the victim F of the Victim F of the Republic of Korea.
