피고인은 2014. 6. 29. 04:55경 울산 남구 B에 있는 C지구대에서 친구인 D가 노래클럽에서 다른 일행과 화장실에서 줄을 서는 문제로 서로 시비가 되어 E을 폭행한 사실로 울산남부경찰서 C지구대 소속 경위 F, 순경 G에 의하여 폭행죄의 현행범인으로 체포되는 것을 보고, H 등 다른 사람들 10여 명이 지켜보는 가운데 피해자 경위 F, 순경 G에게 "야 이 씨발 호로 새끼야. 개 자슥아. 야 이 좆 같은 병신들. 짭새 시팔 자슥들아, 병신 같은 것들아, 개 좆도 모르는 새끼들아, 경찰 좆이라 그래라."라고 큰 소리로 욕설을 하여 공연히 피해자들을 모욕하였다.
