A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From January 1, 2012 to December 28, 2017, the Defendant worked as an employee management, mobile phone sales and storage store operated by the victim D in Nam-gu Incheon Metropolitan City, Nam-gu, Seoul, and engaged in the management of employees, mobile phone sales and computer, and customer management.

1. The Defendant, such as electronic records, read a copy of his identification card received while opening the cell phone to the customer F and opened the cell phone in F’s name, and read the file to open the cell phone and sell the cell phone to the middle and high-class service provider.

On October 4, 2015, the Defendant: (a) connected the LGU Telecommunication Co., Ltd.’s website by using a photofluor PC which was kept in the office of the KGU TU Telecommunication Co., Ltd.; and (b) selected mobile phone subscription application form; and (c) entered the applicant column into “F” and “G” and “H” in the contact column, respectively.

As a result, for the purpose of hindering the management of affairs, the Defendant forged one file of application for mobile phone subscription in the name of F, which is the electronic records of another person with respect to rights and duties, and forged a mobile phone subscription application file at least 61 times as shown in the attached crime list 1.

2. The Defendant, such as electronic records of the above writers, exercised 61 electronic records, which were forged over 61 times in total, as shown in attached Table 1, by transmitting and using the file of the application for mobile phone membership, as if it were duly formed, to a staff in charge of the application for the above-mentioned mobile phone at a time and place as described in paragraph 1, as if it were duly formed, through the Internet.

3. On November 1, 2016, the Defendant: (a) stated “I” in the petitioner column, “J” in the contact column, and “K” in the date of birth on the application form for mobile phone subscription printed out by the agency for the settlement of disputes; (b) stated “I” in the applicant column, “J” in the contact column, and “K” in the name of the applicant.
