Facts of recognition

B Around 2014, a corporation (hereinafter “B”) received “F Corporation” located in Yongcheon-gun E (hereinafter “instant Corporation”) from the Armed Forces Welfare Group at the cost of KRW 102,692,090.

From April 23, 2014, the Defendant determined the contract price of KRW 78,00,000 as the interior works of this case (hereinafter “subcontract”) among the instant construction works, and supplied sewage.

B, on June 21, 2014, the contract amount was finally determined as KRW 102,637,232 after completion of the instant construction and completion inspection by the Armed Forces Welfare Group.

During the subcontract construction period of this case, the Plaintiff was subscribed to the health insurance as a local household worker without his workplace. Under the Defendant’s statement of daily labor and the statement of withholding tax, the Defendant employed the Plaintiff as a daily worker (on-site leader) of the subcontracted construction work in this case. The Defendant paid the Plaintiff wages to other daily workers in order to enable the Plaintiff to pay other daily labor workers’ wages.

The Defendant paid to the Plaintiff with respect to the subcontracted project of this case as follows:
