Reasons
Punishment of the crime
1. No person shall sell fire-fighting appliances without undergoing product inspections or without passing marks in violation of the Installation, Maintenance, and Safety Control of Fire-Fighting Systems Act, display them for sale, or use them for fire-fighting system installation;
Nevertheless, on August 16, 2019, the Defendant sold 12 fire extinguisherss which did not undergo product inspection at KRW 237,600, in the middle-standing factory located in Gangseo-gu Busan Metropolitan Government (C) on August 16, 2019; 2) on August 16, 2019, sold 8 fire extinguisherss which did not undergo product inspection at KRW 198,00,00, and 3) around September 19, 2019 at the “G” located in Busan Metropolitan Transportation Daegu, and sold 10 fire extinguisherss which did not undergo product inspection at KRW 180,00,00,000, and around September 19, 2019, sold 00,000,000,000,000,000,000,000,00,000,00,000,00,00,00,00.
2. Fraud;
A. On August 16, 2019, the criminal defendant against the victim J made a false statement to the victim “C” operated by the victim J in Gangseo-gu Busan Gangseo-gu, Busan, that “Safety Inspection was conducted. It seems necessary to replace the fire extinguishers in the factory. It will be replaced with a new fire extinguishing machine.”
However, in fact, the defendant was only thought to receive money by shocking the fire extinguishers that had been already used by the victim with no knowledge related to fire-fighting, and by issuing a product that did not have undergone product inspection under the law as if it were normal fire extinguishers.
As such, the Defendant, as if he were to sell a normal new fire extinguisher as seen above, deceiving the victim, and then acquired KRW 237,600 from the victim to the Busan Bank account under the name of the defendant, thereby deceiving the victim.
B. The criminal defendant against the victim K is located in Gangseo-gu Busan on August 16, 2019.
