A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On October 30, 2018, the Defendant posted a false statement to the effect that “The sales of game money is made” on the bulletin board of “H,” which is an Internet game, and that “the remittance of money, will send the money to the victim I”.

However, the defendant had no intention or ability to send the game money to the victim properly because he/she had thought that he/she will use the money as a living expense.

As above, the Defendant, by deceiving the victim as above, received 210,000 won from the victim’s J bank account (Account Number K) in the name of the Defendant on the same day, from that time, and received totaling KRW 9,879,000 from the victims in the same manner 28 times from that time until January 20, 2019, as shown in the List of Crimes (1).

On November 24, 2018, the Defendant made a false statement to the effect that “The Victim L purchases a ticket” posted on the Internet M website, and that “The Victim will send the ticket to the customer by way of sending it to the customer.”

However, since the Defendant did not retain crowdfunding at the time, even if he received money from the victim, he did not have any intention or ability to sell the crowdfunding.

Nevertheless, the Defendant, by deceiving the victim as above, received a total of KRW 530,000 from the bank account (J bank K and N bankO) in the name of the Defendant for the sale proceeds twice the same day from the victim and acquired it by transfer.
