A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, as the president of the Busan Dong-gu B building C (G) and D Busan Association, determined the grant of the subsidies to increase the right to enjoy tourism for the people with disabilities, such as the provision of tourist information, counseling, etc. to the people with disabilities, and formed indirect subsidies of KRW 400 million in total of KRW 200,000,000,000,000,000,000,000,000. As such, the Defendant, an indirect subsidy program operator, with due care as a good manager according to the statutes and the purpose of granting indirect subsidies, and used such indirect subsidies for other purposes, the Defendant received 40,000,000 won from Busan Metropolitan City to January 24, 2017.
1. On October 11, 2016, the Defendant: (a) took care of having paid KRW 4,400,000 at the office of Nam-gu Busan Metropolitan Government (State) for the vehicle siren’s expenses for one month; and (b) returned KRW 3,760,000,000, after deducting the fee for H’s card entry into a bank account with H’s numberless numberless numberless; and (c) has paid KRW 4.4 million in the same manner around November 3, 2016; and (d) the same month;

He returned KRW 3,572,500 to the H’s above account, and settled KRW 4.4 million by the same method around December 7, 2016, and returned KRW 3,582,500 to the H’s account on December 12, 2016, and settled KRW 4.4 million by the same method on January 4, 2017, and used the money to purchase the M& car in the Defendant’s name after returning KRW 3,762,00 to the H’s account on January 11, 2017.
As a result, the Defendant submitted a document related to the execution of a national subsidy that executed a total of KRW 17,600,000 per month for four months with the rental fee of a major tourist destination initiation, but executed a total of KRW 490,000 at the actual siren cost of KRW 3 times, and executed a total of KRW 490,000 at the remainder of the national subsidy 17,110.
