1. From March 1, 2014 to April 12, 2016, Defendant C and D respectively to the Plaintiff KRW 8,000,000, respectively, and Defendant C with respect thereto.
Reasons
1. Determination as to the claim against Defendant C and D
(a) Indication of claims: To be as shown in the reasons for the claims;
(b) Defendant C: Judgment on deemed confession (Article 208(3)2 of the Civil Procedure Act): Defendant D by public notice (Article 208(3)3 of the Civil Procedure Act);
2. Determination as to claims against Defendant B, E, and F
A. Basic facts 1) The Plaintiff is a cooperative established pursuant to the Small and Medium Enterprise Cooperatives Act for the purpose of promoting the sound development of wholesale and retail business dealing with industrial products and the promotion of mutual welfare among its members. Defendant B, E, and F invested in the Plaintiff before January 10, 200, Defendant B invested in the Plaintiff, and Defendant B, Defendant E, and F invested in one unit (hereinafter “the first member”), respectively.
2) On July 2, 200, the Plaintiff: (a) newly constructed H shopping malls (hereinafter “instant shopping mall”); (b) on October 11, 200, the Plaintiff sold 14 Dong 107/207 among the said shopping mall to Defendant E, KRW 89,50,000; (c) on January 30, 200, KRW 13 Dong 103 among the said shopping mall to Defendant F, KRW 9,500,00; and (d) on January 30, 2001, KRW 10 Dong 127/27 and 128/28 of the said shopping mall to Defendant B, each of the said shopping mall at KRW 79,50,000,000, out of the basic sales amount.
3) The Plaintiff is the Plaintiff’s general meeting of partners on July 21, 2001 (hereinafter “general meeting of partners on July 21, 2001”).
(4) On April 9, 2005, the Plaintiff held a 13th general meeting of union members (hereinafter “general meeting of April 9, 2005”) on April 9, 2005 and determined the settlement amount per the discount sale of the commercial building of this case as KRW 10,000,000, and decided to substitute the payment of the additional charges already paid by the union members in lieu of the payment of the settlement amount.
