The defendant is not guilty. The summary of the judgment against the defendant shall be published.
Reasons
1. On April 25, 2017, the Defendant, without obtaining a driver’s license, driven a C Carren car at the section of about 3km from the road in front of the west-dong Hong-dong Non-road, Seopo-si, Chungcheongnam-si, Seoul, to the lower end of the two parallel roads in the same Sinwon-Eup, Namwon-si, Seoul, the Defendant driven a C car car at the section of about 3km.
2. Determination
A. Article 93(4) of the Road Traffic Act provides that “In order to revoke or suspend a driver’s license pursuant to paragraph (1) or (2) or to revoke a practice driver’s license pursuant to paragraph (3), the Commissioner General of the National Police Agency of the Korean National Police Agency of the Korean National Police Agency shall, in advance, notify the parties to the disposition of the details and the deadline for submission of their opinions, etc. as prescribed by Ordinance of the Ministry of Administrative Safety and Security prior to the disposition, and in the event of the disposition, he/she shall notify the grounds for the disposition and
Provided, That in order to revoke a driver's license on the grounds that the driver's license has not been inspected pursuant to Article 87 (2) or 88 (1), the driver's license may be revoked by giving a conditional notice of the fact that the driver's license is revoked if the driver's license is not inspected before the expiration date of the aptitude test, as prescribed by Ordinance of the Ministry of Administrative Safety and Security.

Accordingly, Article 93 (1) of the Enforcement Rule of the Road Traffic Act should be issued to a person subject to the prior notice of the suspension or cancellation of a driver's license in attached Form 81 when the local chief police officer or the chief of a police station intends to revoke or suspend a driver's license pursuant to Article 93 of the Act.
Provided, That where it is impossible to confirm the address, etc. of the relevant person by ordinary means or it is impossible to send it, notification may be substituted by publicly announcing it for 14 days on the bulletin board of the police officer having jurisdiction over the relevant person's domicile entered in the
