1. Summary of the grounds for appeal;

A. The judgment of the court below that found the Defendant guilty of the facts charged in this case is erroneous in the misapprehension of facts, which affected the conclusion of the judgment, although the injury suffered by misunderstanding of facts was merely caused by the spathrosis, not by the Defendant’s rape, but by the Defendant’s rape, even if the Defendant suffered bodily injury due to rape, it cannot be deemed that the degree of injury was insignificant

B. The lower court’s sentence of unreasonable sentencing (five years of imprisonment, completion of sexual assault treatment programs for 80 hours, and 10 years of disclosure and notification, respectively) is too unreasonable.

2. Judgment on the assertion of mistake of facts

A. 피고인은 같은 날 14:40경 D가 혼자 집으로 돌아가 피해자와 둘만 남게 되자 피고인은 피해자의 음부 부위를 옷 위로 3~4회 만져 이에 놀란 피해자가 “왜 이러냐.”라며 도망가려 하자 피해자의 오른팔을 잡고 피고인의 집 부엌 안으로 끌고 간 후 그곳에 있던 칼날 길이 약 14cm 의 과도를 집어 들고 피해자의 오른팔에 가져다 대며 “내 말 들어라, 내가 사람을 동강 낼 수도 있고, 니 보지도 도려낼 수 있다, 오른팔을 잘라내 버리겠다.”라고 협박하여 피해자의 반항을 억압한 다음 피고인의 바지와 팬티를 내린 후 성기를 꺼내며 “내 물건 크제, 오늘 못 참겠다, 나하고 오늘 하자.“라고 말을 하면서 피해자의 음부를 만지고 피해자의 입술에 입맞춤을 하고 피해자의 상의를 위로 걷어 올려 브래지어를 내린 후 왼쪽 가슴을 혀로 핥은 뒤 피해자를 방 안으로 데려가 강간하려고...
