1. The summary of the grounds for appeal (unfair sentencing) of the lower court’s punishment (one million won in penalty) is too unreasonable.

2. The change of special circumstances that may differently determine the sentence of the lower court, including the fact that the instant accident occurred while the Defendant was driving in violation of signal signals and the fact that there was two times of punishment for the same kind of crime, cannot be deemed to be unfair because the sentence imposed by the lower court is too unreasonable, considering the overall sentencing circumstances on the records and the changes in the instant case.

Defendant’s assertion is without merit.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is without merit. It is so decided as per Disposition.
