1. The Plaintiff:
A. As to Defendant D’s shares of 6/35 shares in the amount of 4,861 square meters of G forest in Young-gu, Young-gu, Young-si, G, and Defendant E 4.
Reasons
1. Facts of recognition;
A. On September 15, 2003, the Plaintiff purchased 6373 square meters (1,928 square meters) out of the above forest from J, C, and Defendant B, a co-owner of the J, and C, which is the co-owner of the J, and Defendant B, KRW 920 million (hereinafter “the instant sales contract”), and the Plaintiff paid the sales price in full to the said seller.
B. At the time of the instant sales contract, J owned 1/3 shares, C’s 1/3 shares, Defendant B’s 1/6 shares, and K’s 1/6 shares.
C. Around February 3, 2005, L Forest was divided into 8,086 square meters in H on February 3, 2005. On February 19, 2005, J, C, Defendant B, and K, co-owners, divided into H and L, and completed the procedure for registration of ownership transfer, with respect to the area of 8,086 square meters in which H and L are jointly owned by J, C, and Defendant B, and H and 1,617 square meters in H and 1,60 square meters (hereinafter M and 1,60 square meters in land after this forest is divided into M and 1,600 square meters in land, and divided into M, N, andO).
On the other hand, LA forest 8,086 square meters was divided into 7,92 square meters of P forest land on June 3, 2005, and 1,332 square meters of P forest land on July 19, 2005, and 512 square meters of QA forest (the division of 270 square meters of RA forest on July 19, 2005 from the above land) and 6,148 square meters of S A forest. The 6,148 square meters of S forest was divided into 1,287 square meters of land on February 8, 2007 (the 379 square meters of land on December 12, 2008), G forest 4,861 square meters.
E. The Plaintiff had not completed the registration of ownership transfer in accordance with the instant sales contract, which was a land transaction permission area. However, among them, most of the land divided into the size of 8,086 square meters of L forest owned by J, C, and Defendant B, the seller, became a third party, and only C’s 6/15 shares among G forest land and 4,861 square meters (hereinafter “instant land”) and Defendant B’s 3/15 shares remains.
F. C died on July 19, 2017, and as his inheritor, C’s respective inheritance shares of Defendant D (3/7 shares in inheritance) and Defendant E and Defendant F, each of which are his wife’s children.
