Facts of crime

피고인은 처 오ㅇㅇ과 이혼소송을 진행하던 중 오ㅇㅇ이 그녀의 모친인 피해자 김이

ㅇ ( 여, 70세 ) 의 집에 피고인의 아들 박ㅇㅇ을 데리고 있으면서 면접교섭을 이행하지 아니하자, 선배인 김ㅇㅇ과 함께 택배직원을 가장하여 피해자의 집안으로 들어가 피고인의 아들을 데려오기로 마음먹었다 .

피고인은 2011. 11. 4. 20 : 00경 김ㅇㅇ과 함께 서울 영등포구 ㅇㅇ 동 000 - 000에 있는 피해자의 집에 이르러, 김ㅇㅇ은 피해자에게 마치 택배 직원인 것처럼 ' 택배가 왔다 ' 고 거짓말을 하여 이에 속은 피해자가 출입문을 열자 출입문을 세게 잡아당겨 피해자로 하여금 현관 벽에 어깨를 부딪치게 하고, 피고인은 그 사이에 집안으로 들어가 그곳에 있던 아들을 데리고 나오면서 이를 제지하는 피해자의 어깨를 밀쳐 바닥에 넘어뜨렸다 .

이로써 피고인은 김ㅇㅇ과 공동하여, 피해자의 주거지에 침입하고, 피해자에게 약 14일간의 치료를 요하는 경추염좌상 등을 가하였다 .
