A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

1. 2013. 7. 10. 야간주거침입절도 피고인은 2013. 7. 10. 02:00경 내지 05:00경 사이에 속초시 C에 있는 피해자 D의 집 앞에 이르러 옆 집 옥상을 거쳐 피해자의 집 옥상으로 올라간 후 잠겨 있지 않은 창문의 방충망을 뜯고 거실까지 들어가 침입한 다음, 거실 침대 근처에 놓여 있던 피해자 소유인 프라다 검정색 가방 1개를 들고 나와 시가 11만 원 상당인 위 가방 및 그 안에 들어 있던 시가 10만 원 상당인 샤넬 반지갑 1개 등을 절취하였다.
