Punishment of the crime

1. Any person who intends to operate a waste treatment business in violation of the Wastes Control Act shall have facilities, equipment and technical capacity meeting the standards prescribed by Ordinance of the Ministry of Environment and obtain permission from the competent Mayor

From April 26, 2018 to February 21, 2019, the Defendant brought in the PE film, which is a waste, at a factory located in Gyeong-gun, Gyeong-gun, without obtaining a license for waste treatment business, and recycled wastes by manufacturing PE chips through the process of cutting, melting, melting, cooling, cooling, cutting, etc.

Accordingly, the Defendant did waste disposal business without obtaining permission.

2. A person who intends to install a melting facility which falls under the emission facilities of air pollutants violating the Clean Air Conservation Act and has power of at least 15km shall file a report on the installation of the emission facilities with the Mayor/Do Governor

The Defendant melted the PE film cuted by approximately one power 187kW melter and approximately 225kW melter 1, which was installed without reporting the establishment at the same time and place as above paragraph (1).

Accordingly, the Defendant used emission facilities installed without reporting installation.

3. A person who intends to install facilities for manufacturing synthetic resin and plastics, which discharge at least a maximum of 0.1 cubic meters of wastewater per day, including specific substances harmful to water quality or heavy metal in violation of the Water Environment Conservation Act (in cases of a single emission process only, in which wastewater is discharged out of the machinery or facilities in circulation, the quantity of storage facilities attached to the machinery or facilities, other than circular quantity, shall be calculated according to the capacity of the storage facilities attached to the machinery or facilities, if the wastewater is discharged in circulation);

The Defendant used two cooling facilities, cooling towers, and water tanks (capacity 3 tons) installed without filing a report on installation at the same time and place as the above paragraph (1), and carried out the work of planting the PE pressure type directly as cooling water.
