The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for not less than eight months.

1. The gist of the grounds for appeal (the factual error and inappropriate sentencing)

A. Defendant 1 did not deny the fact of the special obstruction of the performance of official duties by mistake of facts, but it is different from the part of the facts charged that “the defendant had expressed his attitude that he would shock E by the chief sentence of early opening of the vehicle,” the part that “the defendant would have committed an assault against the defendant in body and arms at a speed of about 100 km,” the part that “the defendant committed an assault against E by the defendant in body and arms,” and the part that “the defendant threatened E by having the vehicle go without a driver, by having the vehicle go against his own seat from the driver’s seat.” 2) The sentence (one year of imprisonment) sentenced by the court of unfair sentencing is too unreasonable.

B. The sentence imposed by the prosecutor by the court below is too uneasible.

2. 피고인의 사실오인 주장에 관한 판단 피고인을 단속한 경찰관 E는 수사기관에서 “피고인이 시동을 걸려고 하여 제가 시동을 걸지 말라고 하였으나 피고인이 시동을 걸고 갑자기 변속기를 후진으로 넣고 엑셀을 밟기에 조수석 문에 받혀 넘어지지 않기 위해 조수석에 올라탔습니다”, “피고인이 100km 가량 과속을 하여 제가 생명에 위협을 느껴 안전벨트를 착용한 후 정지명령을 하면서 시동을 끄려고 하였으나 피고인이 손을 뿌리치며 계속 주행을 하였으며, 제가 변속기어를 중립으로 했더니 피고인이 어깨로 저를 밀치고, 오른손으로 저의 왼쪽을 잡고 계속 주행기어를 넣으려고 하여 옥신각신 힘싸움을 하게 되었습니다”, "중립상태에서 속도가 줄어들자 피고인이 2차로로 주행을 하면서 문을 열고 도주하려고 하여 도로에서 뛰어내리다가 교통사고 방지 및 도주 방지를 위해 제가 왼손으로 피고인의 허리를 잡고 오른손으로 테이져건을 꺼내 ‘차를 세우고 문 닫으세요 아니면 테이져건을 쏩니다’라고 여려 차례 이야기를...
