A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On June 10, 2016, the Defendant was sentenced to two years of imprisonment with labor for a violation of the Narcotics Control Act (compact) at the Suwon method and completed the execution of the sentence on March 10, 2017.

Despite the fact that the Defendant is not a narcotics handler, the Defendant sold, administered, possessed, received, and delivered the Melopon (one philopon; hereinafter “philopon”) which is a local mental medicine as follows.

1. On July 2, 2017, the Defendant: (a) on July 2, 2017, around July 23:30, 2017, on the front side of the part of the “C” restaurant located in the Gangnam-gu Seoul Metropolitan Government (Seoul); (b) around 10 grams of mert clocks (one name “clocks”; hereinafter “opons”) (one name “clocks”); and (c) sold 200,000 won in cash from D in return.

2. On July 19, 2017, the Defendant: (a) around July 19, 2017, the Defendant: (b) set up five grams of philophonephones contained in D’s plastic sealing to D and sold in cash from D, in the D’s car parked near F in Gangnam-gu Seoul, Seoul, at around 21:00, one million won.

3. On July 29, 2017, the Defendant administered philophone medication by inserting approximately 0.03 grams of philophone into a single-use injection machine at the sterine guest room located in the Nam-gu Incheon Metropolitan City, Nam-gu around the new wall, and dilution with water, and then administering it into his arms.

4. On July 31, 2017, the Defendant possessed approximately 9.5g of opon, approximately 0.71g, approximately 0.75g, approximately 0.65g, approximately 0.31g, approximately 0.31g, approximately 0.05g, approximately 0.05g, and approximately 0.7g, and approximately 0.97g, and about 0.6g of opon in one part of the day-to-day injection equipment, respectively, in a way that he/she puts approximately 13.97gg of opon in a hand-to-day bag carrying with him/her, respectively, at around 21:20 on July 31, 2017.

5. On May 21, 2017, the Defendant receiving phiphonephones to J at the outside “I” and hospital located in Gangseo-gu Seoul Metropolitan Government H around 22:00.
