A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

Although the Defendant was not a narcotics handler due to the shipbuilding of Chinese nationality, he dealt with the Metepha (one philopopon; hereinafter referred to as “philopon”) which is a local mental medicine as follows.

1. Sale of philophones;

A. A. Around May 12, 2018, the Defendant received KRW 800,00 from D before the Defendant’s home located in Sungnam-si, a transfer of KRW 100,000 from D to the company bank account (E) used by the Defendant, and sent approximately 2g of philophones contained in vinyl wings into the G Gun Office located in the Gyeonggi F. Around that time, the Defendant sold philophones by receiving it.

B. Around May 16, 2018, the Defendant received KRW 250,00 from D before the Defendant’s home to the said company bank account, and sent approximately KRW 1g of philophone 1g, contained in vinyl paper, to the said G Gun office, and around that time, sold philophones by receiving them.

At around 17:00 on May 19, 2018, the Defendant: (a) laid down KRW 400,000 in cash from D before the Defendant’s house; and (b) sold 1g of philophones contained in D’s plastic paper to D.

2. Medication of phiphones.

A. On May 12, 2018, around the night, the Defendant administered a phiphone in a manner that puts up “I” hotel 205, located in Sungnam-si H, Sungnam-si H, with approximately 1g of phiphonephones, and inhales the smoke generated by heating the bottom of the phiphones.

B. On May 16, 2018, the Defendant administered approximately 1g of philophones at the same place as before night in the same manner as before the preceding paragraph.

On June 1, 2018, the Defendant administered approximately 1g of philophones in the same manner and at the same place as before the first instance court.

3. On June 2, 2018, the Defendant holding a philophone is kept in the guest room No. 205 of the said “I” hotel where he/she resides in a single-use cellphone by dilution with approximately KRW 3.47g in total of philophones and water, which are divided into four plastic plastic bags on June 2, 2018.
