A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who operated the “C” located in the Jung-gu Incheon City, Jung-gu, Incheon, and arranged illegal employment of foreigners from around 2017, and D is a captain of E.

No person shall arrange or recommend as a business the employment of foreigners who have no status of sojourn eligible for employment activities.

The Defendant is a foreign FF who does not have the status of sojourn eligible for job-seeking activities around September 2018 while engaging in a business of arranging or soliciting the employment of a foreigner who does not have the status of sojourn as a business in running “C” from around 2017;

G. The E master D provided employment services with a referral fee of 10-200,000 won from foreigners listed in the attached list of crimes, such as sojourn status C-3.

As a result, the defendant arranged and recommended the employment of foreigners who do not have the status of sojourn eligible for employment activities as a business.

The sentencing of Article 62(1) of the Criminal Act on the grounds of the suspended sentence is to be determined as the order, taking into account all the sentencing factors, including the Defendant’s age, character and conduct, environment, and circumstances before and after the commission of the crime.
