『2020고단37』- 피해자 B에 대한 업무방해 피고인은 2020. 1. 23 18:10경 남원시 C에 있는 피해자 B(남, 52세)이 운영하는 식당에 들어가 피해자에게 술을 주문하였으나, 피해자가 ‘이전에 술을 마시고 위 식당에서 행패를 부린 피고인에게 술을 줄 수 없다’는 취지로 말하자 이에 격분하여, 그곳에서 근무하고 있는 피해자 B의 부인인 D에게 “씨발 좆같네.”라고 욕설한 다음, 위 식당에서 술을 먹고 있는 성명불상의 여자 손님에게 다가가 “누나야 내가 뭘 잘못 했어, 씨발 좆같은 년, 좆같네.”라고 말하고, 이어 다른 테이블에서 술을 마시고 있는 성명불상의 남자 손님에게 다가가 “형님아 내가 뭐 잘못한 것 있어, 좆같은 놈, 좆같네.”라고 욕설하는 등 같은 날 19:00경까지 약 50분간 소란을 피우는 방법으로 피해자 운영의 위 식당에서 식사 중인 손님들로 하여금 식당을 나가게 하여, 위력으로 피해자의 식당 운영업무를 방해하였다.
