A defendant shall be punished by imprisonment for not less than one year and six months.

Provided, That the execution of the above punishment shall be suspended for two years from the date this judgment became final.

피고인은 2015. 8. 9. 01:10경 대구 중구 C에 있는 피해자 D(29세)이 운영하는 식당에서, 피해자가 마감할 시간이 되었으니 술자리를 정리해줄 것을 요청하여 기분이 나쁘다는 이유로 그곳 테이블에 있는 위험한 물건인 소주병으로 피해자의 좌측 귀 부분을 1회 내려쳐 피해자에게 약 2주간의 치료를 요하는 좌측 귓바퀴의 열린 상처 등을 가하였다.
