A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On December 2, 2015, the Defendant: (a) obtained one copy of the resident registration certificate lost by the victim B in front of the D Gameland located in Busan, Jin-gu, Busan; and (b) did not take necessary procedures, such as returning the certificate to the victim; and (c) embezzled him/her on his/her idea.

2. When the Defendant went out of Korea with E as a friendship, and the living expenses, etc. were insufficient, the Defendant was recruited to use the Internet page account and the persons who want to purchase heavy goods, after receiving the payment.

According to the above public offering on September 9, 2016, the Defendant sent the Defendant’s “G page” message to the victim H who wants to access the Internet at the Defendant’s home located in Gangnam-gu Seoul, Seoul, to purchase the “G” page’s account, and then sent the Defendant’s “G page” message to the Defendant. The Defendant reported that the Defendant would deposit money in advance and transfer it to the manager’s account of the PP page,” and the Defendant provided the Defendant with his driver’s license photograph to inform the victim of the crime.

However, in fact, the defendant and E did not hold the above account and was thought to use it as living expenses, etc. by pretending to sell the account, so even if they received money, they did not have the intention or ability to transfer the account to the victim.

The Defendant, in collusion with E, received KRW 3,950,00 from the victim to the Agricultural Cooperative Account under the name of the Defendant for the purchase price of the North Korea account, from November 14 of the same year, and acquired KRW 7,370,000 in total on six occasions, such as the list of crimes in the attached crime, from November 14 of the same year.

3. On November 21, 2016, the Defendant’s unlawful uttering of official documents is as described in paragraph 1, who was requested to present an identification card to verify his/her identity by LW at the first basement of Seocho-gu Seoul, Seocho-gu Seoul Metropolitan Government Police Station K Team affiliated with the Gu Government Police Station K Team in order to verify his/her identity.
