1. The judgment of the court of first instance is modified as follows.
The Defendant-Counterclaim Plaintiff (Counterclaim Defendant) is the Plaintiff (Counterclaim Defendant) and the 1 South Si.
Reasons
A principal lawsuit and counterclaim shall also be deemed a principal lawsuit and counterclaim.
1. Facts of recognition;
A. On July 24, 2015, the Plaintiff related to the parties acquired the ownership of each land listed in the separate sheet (hereinafter “instant land”). Defendant B, on December 27, 200, acquired the ownership of each land indicated in the separate sheet (hereinafter “instant land”) and Defendant B, from around December 27, 200, divided into 850 square meters (332 square meters and 518 square meters in I miscellaneous land on March 12, 2003, and the land category of the instant I 332 square meters in land was changed to a site on May 31, 207; hereinafter “I 332 square meters in land”; from around December 2012, the Defendants, as married couple, acquired the ownership of the instant restaurant from the land to the “J” (hereinafter “instant restaurant”).
B. 1) The instant land is located between K and the restaurant of this case. 2) The Defendants used part of D land as a parking lot of this case in the order of the attached Form 3, 8, 9, 10, 11, 12, 13, 14, 15, 16, 16, 4, 5, 6, 7, 7, and 8, and the portion of “bbb” in the order of 345 square meters and the portion of attached Form 31, 32, 33, 34, 35, 36, 46, 45, 37, 38, 29, 30, 30, and 31, which are part of F land, as a parking lot of this case. The Defendants connected the part of attached Form 3, which is part of D land, with the part of attached Form 3, 238, 29, 238, and 31.
3) The Defendants stated ten landscape trees on the ground of 345 square meters in the attached Form 3 drawings, which are part of D land, connected each point of 8, 9, 10, 11, 12, 13, 14, 15, 16, 4, 5, 6, 7, and 8, which are part of D land, and installed a landscape management room on the ground of 7 square meters in the ship, which connects each point of 43, 44, 45, 46, and 43 of the attached Form 3 drawings, which are part of F land, each point of 47, 48, 49, 50, and 47 of the attached Form 3 drawings, and installed a landscape management room on the ground of 2 square meters in the part of D land, which is part of G land, which is part of the attached Form 3 drawings.
